Many policies on Amazon Europe have changed, such as CE marking, European generation, IOSS, as well as WEEE, packaging law and battery law regulations. In such a changeable environment of cross-border industry, every policy introduction and update is not a small impact on sellers.


In the face of each policy change, what issues should Amazon sellers be concerned about?

CE certification is a mandatory product safety certification implemented by the European Union countries, indicating that the goods comply with the European Economic Area (EEA) health, safety and environmental protection standards, the majority of domestic products exported to the EU need to have CE mark.


The following are some of the product categories that need CE certification for sellers' reference: 


Power supply: communication power supply, charger, monitor power supply, LCD power supply, UPS, etc.; 

Lamps and lanterns: pendant lamps, track lights, portable lamps, table lamps, T8 lamps, etc.; 

Home Appliances: fans, electric kettles, stereos, televisions, vacuum cleaners, etc.; 

Electronics: routers, cell phone batteries, laser pointers, vibration sticks, etc.; 

Wireless: wireless keyboards, mice, microphones, wireless network, Wireless: wireless keyboard, mouse, microphone, wireless network device, transceiver, wireless bluetooth, image transmission receiver, other low-power wireless products, etc.; 

Machinery: welding machine, CNC drilling machine, tool grinder, washing equipment, gasoline welding machinery, printing machines, printers, etc.; 

Wired communication: telephone, wired phone wireless main and vice, fax machine and other communication products;

Note: Products that require CE marking must be CE certified.


What is the European generation? European generation that there is CE certification of the product packaging, labels, instructions for use to have an authorized representative of the European Union. Amazon has updated its European light bulb sales policy as follows: 

Effective October 1, 2021, certain light bulbs, fixtures, and item types, such as clear incandescent (15w, 25w, 40w, 60w, 65w, 70w, 75w, and 100w), frosted incandescent, and halogen (with the exception of R7, G9, GU5.3, G4, and GY 6.35 socketed models), will be banned from sales and all items will be removed from Amazon Eurostore.


Speaking of light bulbs, sellers have to understand the German WEEE and battery law, Amazon for the German WEEE and battery law for a long time in the stage of strict investigation, sellers in the sale of products must be clear whether the product is in line with this regulation.


What is WEEE? 

Waste Electrical and Electronic Equipment Recycling Act, the implementation of the European Union Directive (WEEE), used to regulate the recycling of all electrical and electronic products in Germany, requiring sellers to take back the disposal of sold waste electrical and electronic equipment.


When is German WEEE required? 

Anyone placing electrical or electronic equipment on the German market for the first time must register for WEEE. 


What are the consequences of not registering for German WEEE?

The German authorities require Amazon to notify cross-border sellers selling on the platform to register for WEEE, and sellers are not allowed to sell without obtaining WEEE. If a seller violates other obligations under Article 45 of the WEEE, the following penalties apply: 

1. A fine of up to 100,000 euros; 

2. Confiscation of revenues deemed illegally obtained in Germany; 

3. No sales may be made until the fine is paid.


Which products need to be registered for WEEE? 

1. Heat exchangers 

Appliances with integrated circuits which use substances other than water, such as gases, oils, refrigerants and refrigerants, or secondary substances, for cooling/heating or dehumidifying purposes. Such as: refrigerators, freezers, air conditioners, dehumidifiers, heat pumps.


2, screen equipment 

Electronic equipment used to display images and information on an electronic screen, regardless of the size of the screen. Such as: monitors, televisions, liquid crystal displays, notebooks / tablet PCs, electronic book readers, and control equipment.


3、Lighting Equipment 

Facilities used in the production of lamps, referring to electric light sources that can be installed or replaced by the end-user in designated end-use equipment. For example, fluorescent lamps, compact fluorescent lamps, discharge lamps, and LED lamps.


4. Large electronic equipment 

Appliances with external dimensions exceeding 50 centimeters that are not already covered by categories 1-3. For example: large household appliances, consumer electronic equipment, electric heaters, ventilators, tanning beds, photovoltaic modules, etc.


5、Small electronic equipment 

Appliances with external dimensions less than or equal to 50 centimeters but not yet covered by categories 1-4 or 6. Such as: small household appliances, flashlights, small fans, watches, light bars, electronic scales, speakers, MP3, cameras, etc.. (Currently Amazon sellers products are dominated by category 5) 


6. Small IT and telecommunication equipment 

Collecting, transmitting, processing, storing and presenting information and electronic equipment for telecommunication transmission of signals, voice, video and data, spatial distances, with external dimensions of less than or equal to 50 centimeters, which are not yet covered by categories 1-4. For example: cell phones, GPS navigation, computers, printers, routers, telephones.



What is the Battery Law?

The German Battery Law BattG regulates the recycling of batteries and accumulators and requires sellers of batteries and accumulators on the German market to recycle sold batteries. This law applies to all types of batteries, regardless of shape, size, weight, material composition or use.


In what cases is the German Battery Law required?

Anyone who puts batteries, accumulators, devices with built-in or enclosed batteries on the German market for the first time.


The seller must fulfill the obligations of the German Battery Law: 

1. Register for the Battery Law before selling batteries and accumulators; 

2. Print the Battery Law icon on the product or packaging; report the number of sales on a regular basis; 

3. Provide suitable equipment to return batteries placed on the market and ensure that the product is disposed of in an environmentally friendly manner.


Consequences of not registering for the German Battery Law: 

1. A fine of up to 100,000 euros; 

2. Confiscation of all profits considered illegal in Germany; 

3. Goods are seized by customs, ASINs are deleted, and links are taken off the shelves.


The difference between WEEE and German battery 

1, different recyclables 

WEEE is the end-of-life electrical and electronic recycling directive, only recycling electrical appliances, not recycling batteries; 

Battery Law is a battery recycling directive, is specialized in recycling batteries, not recycling electrical appliances.

2, the scope of registration is different 

WEEE for all electrical and electronic equipment in the European Union, all electrical appliances related to the goods need to be registered; 

Battery law is only for electronic products with batteries.

Germany's new packaging law for 2019 requires all products to be packaged and registered, be subject to the VerpackV and VerpackG Acts, and bear the cost of selling product packaging for recycling.


Consequences of not complying with the packaging law: 

Sellers selling goods on the German marketplace face fines of up to €50,000 and a sales ban if they do not comply with Germany's latest packaging law.

Since January 1, 2021, after the United Kingdom left the European Union, the UKCA logo officially opened for use, the product sales to the United Kingdom need to be affixed with the UKCA logo! CE logo has been gradually disapproved.


CE mark has been gradually disapproved. With the European representative of the same reason, the British representative of the British authorized representative, refers to the seller in the United Kingdom to sell goods with CE/UKCA mark of the person in charge of the United Kingdom, after obtaining the UKCA certification, the product packaging with the UKCA logo, but also to indicate the name and address of the British representative of the company, to ensure that the product can be traced back.


UKCA use rules: 

1, the UKCA logo can only be affixed to the product as the manufacturer or its authorized representative; 

2, in affixing the UKCA logo, the manufacturer of the product meets the requirements of the relevant regulations to assume full responsibility; 

3, the manufacturer must only use the UKCA logo to prove that the product complies with the relevant UK regulations; 

4, the manufacturer shall not be possible to misunderstand the meaning of the UKCA logo or any form of logo placed on a third party; 5, the manufacturer shall not put the UKCA logo on the third party; 5, the manufacturer shall not use the UKCA logo to prove the compliance of the product with relevant UK regulations. Mark on a third party; 

5. Manufacturers must not attach any other mark to the product that affects the visibility, legibility or meaning of the UKCA Mark;

Toy Safety, Recreational Crafts and Personal Vessels, Simplified Pressure Vessels, Electromagnetic Compatibility, Measuring Instruments, Lifts, Radio Equipment, Pressure Equipment, Gas Appliances, Machinery, Aerosols, Low Voltage Electrical Equipment, Restriction of Hazardous Substances, etc.
